Powers of Attorney
One day you may reach a stage in life when you are no longer capable of managing your own affairs . It is possible to plan for such an eventuality by putting in place a Power of Attorney. This is a legal document which allows someone you trust , usually a relative or close friend, to act on your behalf and take all-important financial and welfare decisions for you, in other words for them to act as your "attorney".
Unfortunately, people seldom recognise the importance of putting in place a Power for Attorney and leave the thought until it is too late.
A Power of Attorney can only be put in place while you are of sound mind. If you leave it too late and need help to manage your affairs then a "guardianship order" will have to be applied for through the courts. This is a lengthy and expensive process.
It is much more advisable for you to take control now and nominate a person of your choice to manage your affairs prior to the need arising.
There is a clause which we can include within your Power of Attorney which ensures that the attorney's power is not activated until you are unfit to look after your affairs.
